KLANIK, a French société par actions simplifiée with its registered office at 221 avenue du Prado 13008 Marseille and its affiliated companies ("KLANIK" or "we"), is responsible for processing the personal data collected on its website www.klanik.com and its sub-domains ("Site") and in the context of its recruitment and service provision procedures.  

This privacy policy aims to inform visitors to the Site and applicants ("Visitor", "You", "Applicant") about how KLANIK processes, collects and uses your data.

1/ What personal data do we collect and for what purposes? 


1.1 As a data controller 


The personal data we collect concerns our Candidates, service providers, customers, partners and users of our Site. They are as follows: 


Candidate Data 

If You are a Candidate, You can contact us via the contact form accessible on our Site, or when You apply for a job offer on the Site or on the site of one of our partners or by any other means such as via our recruitment game World Of Klanik or in the context of recruitment forums or fairs. 

The data collected is intended for recruitment management purposes and is processed solely to assess the Candidate's professional abilities and aptitudes for the position offered. To this end, the Candidate is asked to provide the following information: 

  • Identification data (including surname, first name, date of birth, e-mail address, postal address, telephone number, photo if applicable) 
  • Residence permit / work authorization (if applicable)
  • Curriculum Vitae 
  • Driver's license (if applicable) 


Without the provision of this data, participation in the recruitment process will be impossible. 


We may also collect other personal data that the applicant chooses to provide to us, such as : 

  • Family situation 
  • Availability 
  • Geographical mobility 
  • Cover letter 
  • Salary expectations

The processing of our Candidates' personal data aims 

  • Receive and analyze candidate applications; 
  • Recruit candidates ; 
  • Determine candidates' suitability for the position, if necessary, through knowledge tests 
  • Keep the candidate informed about the recruitment process; 
  • Administratively manage the candidate's file 
  • Send information related to new job offers that may match the candidate 
  • Conduct satisfaction surveys for internal statistics 
  • Verify work authorization (only for foreign candidates 
  • If the application is successful, proceed with the candidate’s hiring and manage their employment contract; 
  • Establish statistics related to job offers  

 

Partner Data 

As a data controller, we may collect personal data from the management of our client or provider companies or participants in our professional events 

Client/Provider data may include:

  • Interview reports (candidates/clients)

  • Manage participant registration for the event 
  • Communicate with the participant regarding their event participation 
  • Conduct commercial prospecting (if the participant has expressly consented)

  • Improve our communication and marketing strategy; 
  • Conduct marketing and statistical analyses  

 


Site User Data 

When you visit our Site, we record your computer's IP address and browser settings (web browser software used, referring website, and information related to your online activity).  

Browser settings may include the browser type, browser language, and time zone. 

We use cookies and similar technologies to collect many of these details, and our cookie policy provides more information on this subject.  

The Site user can also contact KLANIK via the contact form.   

This information is collected to:

When we do not obtain your personal information directly from you, we may obtain it from the following sources: publicly accessible sources (registers or Internet), KLANIK employees, subcontractors, KLANIK affiliates, employers of our subcontractors, public authorities, public websites, social media, previous employers, educational institutions, suppliers, and vendors (including third-party data providers). 


1.2 As a data processor  

We also act as a Data Processor as defined by the Applicable Regulations when we operate on behalf of our clients. As part of our services, we process certain personal data stored on the client's information system. We act only on the client's written instructions, defining the purposes and retention duration per the contract terms concluded with them  

 

2/ On which legal basis do we process data?  

We only process your personal data to the extent that this processing meets at least one of the following conditions: 

  • You have consented to this processing for the purposes outlined above; 
  • This processing is necessary for providing and improving our services and maintaining a secure environment; 
  • This processing is necessary for compliance with various legal obligations to which we are subject; 
  • This processing is necessary to protect our legitimate interests, particularly concerning the processing of Candidate data. 


3/ What is the data retention period? 

We only retain and store your data for the period strictly necessary for the purposes defined in Article 1 of this Privacy Policy.

4/ With whom do we share the data? 

Depending on the purpose of the processing, your personal data may be treated confidentially by authorized personnel (communication, commercial, customer relations, administrative, human resources, and functional support services) of KLANIK. 

Your data may also be shared with third-party companies acting on behalf of KLANIK when we use service providers to provide and maintain our services  

Regarding recruitment management processes, the human resources department will transmit some of the information collected to organizations informed of the Candidate's final hiring (notably unemployment insurance, health insurance, retirement, mutual insurance). The Candidate, requalified as an employee, will be comprehensively informed about the various data processing operations carried out by KLANIK as part of and within their employment contract. 

Your data may also be shared with our client companies for the provision of services. 

KLANIK may also transfer your personal data to one of its affiliated companies, some of which are located outside the European Union.  

In this context, we undertake to verify that all our service providers comply with the GDPR.  


We require all our partners to provide sufficient guarantees demonstrating that appropriate technical and organizational security measures have been taken to protect personal data. 

  • If required by law, we may transmit data to respond to claims against us and comply with administrative and judicial procedures; 
  • If we are involved in a merger, acquisition, asset transfer, or bankruptcy proceedings, we may transfer or share some or all of our assets, including personal data 


Given the organization of our company, we may need to share some of your data with affiliated companies of our group, which may be located outside the European Economic Area. 


In this case, we ensure that the third country provides a sufficient level of protection as defined by the supervisory authorities and that appropriate measures and controls are in place to comply with applicable laws and regulations to protect your data. 

 


5/ How do we secure the data? 


We apply organizational, physical, and technical security measures for all personal data held by us. We have established protocols and control measures as well as appropriate policies, procedures, and guidelines to ensure the proper application of these measures, taking into account the risks associated with different categories of personal data and their processing. 

Despite all these measures, we want to draw your attention to the fact that the Internet is not a completely secure environment, so we cannot guarantee the security of data transmission and storage. 

We commit to notifying the CNIL as soon as possible of any data breaches that may pose a risk to the rights and freedoms of individuals.

According to the Applicable Regulations, you have the following rights: 

  • Right to access your personal data and any information about it; 
  • Right to rectify, delete, and move your personal data; 
  • Right to restrict and object to the processing of your personal data; 
  • Right to withdraw your consent; 
  • Right not to be subject to an entirely automated decision. 

You also have the right (where applicable) to issue general or specific directives regarding the retention, deletion, and communication of your personal data after your death. 


How can I exercise my rights? 


You can make your requests in various ways: 

 

Please make each request by one of the above means, attaching a copy of your identity documentation. This step allows KLANIK to verify your identity before transmitting any category of personal data. This document will be deleted once your request is closed. 

 

In case of manifestly unfounded or excessive requests, KLANIK may require the payment of reasonable fees that arise from the administrative costs incurred to provide the information or refuse to comply with these requests 



Is there a recourse? 

If you believe that your rights are not respected after contacting us, you can file a complaint with the Commission Nationale de l’Informatique et des Libertés (CNIL - the competent French supervisory authority):
