Article 1: Purpose Purpose

The present GTC or General Terms of Use provide a legal framework for the use of the services of the klanik.com site (hereinafter referred to as the "Site").

The use of the Site implies the full and complete acceptance of the general conditions of use described below. These conditions of use may be modified or completed at any time, and the Users of the Site are therefore invited to consult them regularly.

Article 2: Access to the Site

This Site is normally accessible at any time to the Users. An interruption for reason of technical maintenance or update can however be decided by KLANIK. The access to the Site can thus be interrupted or suspended by the editor without notice nor justification.

Access to this Website is free of charge. The User acknowledges that he/she has the necessary skills and means to access and consult this Site. The costs of access and use of the telecommunications network are the responsibility of the User, according to the terms and conditions set by his access providers and telecommunications operators. 

The Site provides free access to the following services:

  • Consult the services offered by KLANIK,
  • Contact the KLANIK teams
  • Consult the job offers of KLANIK
  • Apply to KLANIK's job offers or spontaneously through the contact form

Access to the dedicated services does not require a login or password.

The fact of accessing or remaining fraudulently in a computer system, of hindering or distorting the functioning of such a system, of introducing or modifying fraudulently data in a computer system constitute offences liable to penal sanctions (Penal Code, Articles L.323-1 and following). 

Article 3: Data collection

The collection of information such as name and email when requesting contact on the Site, or to send an application is necessary. In accordance with the law n°78-17 of January 6, relating to data processing, files and freedoms, the collection and processing of personal information are carried out in the respect of the private life.

Following the French Data Protection Act dated January 6, 1978, Articles 39 and 40, and in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, applicable on May 25, 2018, on the protection of individuals with regard to the processing of personal data and on the free movement of such data (RGPD), the User has the right to access, rectify, delete and object to his personal data. Article 4: Intellectual property

KLANIK is the owner of the intellectual property rights or holds the rights of use on all the elements accessible on the Site, in particular the texts, images, graphics, logo, icons, sounds, software.

The reproduction and copying of the contents by the user require prior authorization from the Site. In this case, any use for commercial or advertising purposes is prohibited.

The use of all or part of the Website by the User for private use and for non-commercial purposes is lawful.

However, any other use for public and/or commercial purposes, in particular by extraction, downloading, reproduction, transmission, reverse engineering, decompilation, disassembly, representation or distribution, is strictly prohibited. 

The violation of this prohibition subjects its author to the sanctions provided by the Code of the intellectual property under the copyright infringement (articles L.335-3 and following), of right of the marks (articles L.716-1 and following), of right of the drawings or models (articles L521-1 and following), but also to the sanctions provided by the Civil code under the civil liability of common law (article 9, articles 1240 and following). 

Article 5 Responsibility

Although the information published on the Site is deemed reliable, the Site reserves the right not to guarantee the reliability of the sources.

The information published on the Site is presented for information purposes only and has no contractual value. In spite of regular updates, the Site cannot be held responsible for any changes in administrative and legal provisions appearing after publication. The same applies to the use and interpretation of information provided on the platform.

The Site declines all responsibility for any viruses that may infect the User's computer equipment after using or accessing this Site.

The Site cannot be held responsible in case of force majeure or the unforeseeable and insurmountable fact of a third party.

In addition, the Site implements all the methods required for the respect of the security and confidentiality of the data.

Article 6 : Hypertext links

Incoming links

The owner of the Site authorizes hypertext links to any page of this Site, provided that these open a new window and are presented in an unequivocal manner in order to avoid: any risk of confusion between the citing Site and the owner of the Site as well as any tendentious presentation, or contrary to the laws in force.

The owner of the Site reserves the right to request the removal of a link if it considers that the source Site does not respect the rules thus defined.

Outgoing links

The Site may contain hyperlinks. By clicking on them, the User will leave the platform. The latter has no control and cannot be held responsible for the content of the web pages related to these links.

Article 7 : Cookies Cookies

During visits to the Site, a cookie may be automatically installed on the User's browser.

Cookies are small files that are temporarily stored on the hard drive of the User's computer. These cookies are necessary to ensure accessibility and navigation on the Site.

Article 8 Applicable law and competent jurisdiction

The content of the Site is subject to the law applicable in France and more particularly to the law for the Confidence in the Digital Economy (Article 6 of the law n°04-575 of June 21, 2004). Any User acknowledges the jurisdiction of the French courts for all matters relating to the content and use of the Site or any recourse arising therefrom.
